PREAMBLE
Gurunite (hereinafter referred to as “Gurunite“, “we“, “us“, or “our“) operates the freelance marketplace located at gurunite.com (the “Platform“). We are committed to protecting the privacy and personal data of our users, including Clients (Buyers) and Freelancers (Sellers) (collectively, “Users” or “you“).
This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit and use our Platform. By accessing or using the Platform, you explicitly consent to the data practices described in this policy. IF YOU DO NOT AGREE WITH THE TERMS OF THIS PRIVACY POLICY, PLEASE DO NOT ACCESS THE SITE.
SECTION 1: INFORMATION WE COLLECT
Because Gurunite does not enforce mandatory identity verification (KYC) at registration, we only collect the minimum required data to operate the marketplace safely:
- Account Profile Information:
- Provided by You: Username, email address, password, profile picture, skills, professional descriptions, hourly rates, and portfolios.
- Public Display Notice: Any information you fill into your public Freelancer or Client profile is visible to all visitors of the Platform. Gurunite is not responsible for any misuse of information you voluntarily choose to make public.
- Transaction and Delivery Data:
- Project descriptions, job postings, file attachments, chat logs, messages, and order milestones submitted through the Platform’s workspace.
- Automatically Collected Technical Data:
- IP address, browser type, operating system, device identifiers, referral URLs, page views, and timestamps when you interact with the Platform.
- No Direct Financial Data Collection:
- Gurunite DOES NOT store credit card numbers, bank account details, or CVV codes on our servers. All payments are processed directly by our secure, PCI-DSS compliant third-party payment gateways (e.g., Stripe, PayPal). Your financial data is governed solely by those respective third-party privacy policies.
SECTION 2: HOW WE USE YOUR INFORMATION
We process your personal data under legal grounds including contract performance, legal obligations, and legitimate business interests:
- To facilitate connections, service postings, and communications between Clients and Freelancers.
- To process and clear administrative service fees via our third-party payment processors.
- To optimize platform performance, troubleshoot technical errors (such as debugging server 413 Request Entity Too Large errors), and maintain system security.
- To detect, prevent, and mitigate fraudulent activities, spam, malicious code, or attempts to circumvent our payment infrastructure.
- To send essential transactional notifications, account updates, and customer support responses.
SECTION 3: DATA RETENTION, UPLOADS, AND TECHNICAL LIMITS
- General Retention: We retain your personal data and account logs only for as long as your Account remains active or as required to fulfill our legitimate business and tax compliance obligations.
- File Upload Cache: Project attachments and deliverable files uploaded via our cloud infrastructure are cached and stored on our secure Hostinger/CloudPanel servers.
- Infrastructure Exceptions: Files that trigger standard server limitations (such as 413 errors exceeding 512MB limits) are automatically dropped by our Nginx proxy layer. Gurunite does not log, parse, or recover data from corrupted, failed, or partial transmissions resulting from user attempts to exceed file limit configurations.
SECTION 4: SHARING AND DISCLOSURE OF INFORMATION
We do not sell, rent, or lease your personal data to third parties for marketing purposes. Your data is shared exclusively under the following conditions:
- With Other Users: To execute Service Contracts, your username, profile reviews, and project communication are visible to the party you are collaborating with.
- With Service Providers: We share technical metadata with trusted cloud-hosting vendors (e.g., Hostinger, CloudPanel), security firewalls, and analytics tools that operate under strict confidentiality agreements.
- For Legal Protection: We will disclose information if required to do so by a lawful subpoena, court order, or government regulation, or to protect the safety, intellectual property rights, and physical integrity of Gurunite, our employees, or our Users.
SECTION 5: COOKIES AND TRACKING TECHNOLOGIES
Gurunite utilizes standard HTTP cookies, web beacons, and local storage tokens to enhance user experience, preserve login sessions, remember user types (Employer vs. Freelancer), and analyze site traffic patterns. You can modify your browser settings to decline cookies; however, doing so may disable core functionalities of the marketplace (such as persistent login or real-time notification components).
SECTION 6: INTERNATIONAL DATA TRANSFERS
Gurunite is hosted on secure cloud infrastructure that may be located outside of your resident country or jurisdiction (including servers managed via Hostinger). By using the Platform, you explicitly acknowledge and consent to the transfer, storage, and processing of your personal information across international borders, in compliance with applicable standard contractual clauses.
SECTION 7: DATA SECURITY AND LIMITATION
We implement appropriate technical, organizational, and administrative security protocols (including SSL/TLS data encryption and CloudPanel firewall rules) to minimize unauthorized access, data breaches, or modification. However, no data transmission over the internet or cloud-hosting network can be guaranteed 100% secure. You upload all data, portfolios, and communications at your own absolute risk.
SECTION 8: YOUR PRIVACY RIGHTS (GDPR & CCPA COMPLIANCE)
Depending on your geographical location, you possess specific statutory rights regarding your personal data:
- The Right to Access / Portability: You may request a digital copy of all personal data we hold about you.
- The Right to Rectification: You have the right to edit or update inaccurate profile credentials at any time via your Account Settings.
- The Right to Erasure (“Right to be Forgotten”): You may request the permanent closure and deletion of your Account, provided you have no unresolved financial balances, open disputes, or active Service Contracts.
- Opt-Out Rights: You may opt-out of receiving promotional emails from us by clicking the “Unsubscribe” hyperlink embedded within the footer of our emails.
SECTION 9: THIRD-PARTY LINKS AND EXTERNAL SERVICES
Our Platform contains hyperlinks to external websites, portfolio links, or integrated payment widgets. Once you leave gurunite.com, Gurunite exerts no operational control over external websites. We are not responsible for the privacy practices, content protection, or cookie policies enforced by any third-party website or application.
SECTION 10: CHANGES TO THIS PRIVACY POLICY
Gurunite reserves the right to modify, revise, or update this Privacy Policy at any time and at our sole discretion. When modifications are published, we will immediately revise the “Effective Date” prominently displayed at the top of this document. Continued use of the Platform after an update constitutes absolute acceptance of the revised policy.
